PAID HOSTING TERMS OF SERVICE
The service that is subject to the following agreement is provided by FarOffice Limited, whose website is faroffice.co.uk, registered in the United Kingdom, Registration No. 06465588. You should be aware that by signing up for an account with FarOffice, you agree to position data on our servers, thus making it accessible to the wider public. In this sense, you accept that it is beyond the power of FarOffice to restrict such access and guarantee the security of your files. You are completely in charge of protecting your data on FarOffice servers. Please consider carefully any information before uploading it to your newly allocated FarOffice server space. You should abide by the Domain Name Registration Agreement, which is an indivisible part of this document, whether you have made the Agreement yourself or through FarOffice Limited.
1. ENTIRE AGREEMENT; SERVICE AGREEMENT
FarOffice shall provide its Services to You (the Customer) under the Terms and conditions of this Customer Agreement. The Agreement is intended to keep the integrity of both FarOffice and the Customer and to protect both parties from liability. This Service Agreement will be enforced to ensure the speed, power, performance, and reliability of our services. Along with the Contract and any other documents or agreements explicitly specified in this Agreement, the Customer Agreement constitutes the whole act of convention between FarOffice and the Customer, thus being the most significant document of the newly-established relationship. In the case that a court of competent jurisdiction considers that any of the Agreement’s provisions is invalid, unenforceable, or void, the remaining ones will completely reserve their validity. The Customer’s side of the Agreement may be presented by the following parties: an individual with personal demands, being over 18 years of age; a legal entity such as a corporation, a limited liability company etc. that is consistent with legal system. If a person represents the Customer for some reason, they should be legally authorised to act in their name, thus accepting, executing and delivering the Agreement. You understand and agree that the Service is provided “AS IS” and that FarOffice assumes no responsibility for the timeliness, deletion, and failure to deliver or store any Customer communication or personalisation settings.
2. FAROFFICE HOSTING SERVICES
a. Bandwidth — Each hosting plan includes prepaid bandwidth. Additional bandwidth is available. Contact FarOffice for more information. This bandwidth must be prepaid before use or the account will be suspended for bandwidth over–use. b. Domains Hosted — FarOffice hosting plans include domain hosting. Each hosting plan has a limit on the domains hosted. c. Domain Registration — is available as an option when purchasing web hosting account(s). Contact FarOffice for more information. Domain registrations cannot be refunded. d. Disk Space — Additional disk space is available. Payment is accepted only in advance per year. e. Email — Users are NOT allowed to send more than 1500 emails per day / 150 email per hour per hosting account (each email can be sent to maximum 50 recipients, as each unique recipient will be counted as one message sent). When sending emails via a Mailing List, users are NOT allowed to send more than 1500 emails per day per account (or 1 email to 1500 subscribers, respectively). Each web hosting account is entitled to 2 GB email storage, which is shared between all mailboxes created for this account. f. IP Address — FarOffice hosting accounts do not include an IP address. For many customers an IP address is important for starting SSL hosts and we’re happy to arrange the purchasing of IP addresses for you. Payment is accepted only in advance per year. Contact FarOffice for more information. g. MySQL Database(s) - is/are available in all hosting plans. Additional MySQL databases may also be purchased. Contact FarOffice for more information. h. Database Storage — FarOffice offers unlimited MySQL database storage for each hosting account. However, accounts with very large single databases can affect the overall server performance. Thus, we recommend that each database is kept under 200 MB in size. For accounts with databases over 500 MB in size, FarOffice may request that the number of total database usage be reduced to ensure proper performance or may terminate the Subscriber’s account, with or without notice. i. SSH — not included in hosting plans, but it is available. Contact FarOffice for more information.
3. SERVICE PAYMENT
When signing up for an account with FarOffice, the Customer agrees to pay for the period of one year and abide by our Terms Of Service. FarOffice will charge customers fees based on the fee structure of our web hosting system at the time of the sign–up process. FarOffice reserves the right to introduce price changes to the packages when needed. This means that the current price list on our website may differ from the pricing of your web hosting account. FarOffice reserves the right to introduce certain changes to the packages.
4. SERVICE GUARANTEES
FarOffice will guarantee 99.5% network uptime and 99.5% network stability uptime. This, however, does not refer to problems stemming from: a. Server Hardware Breakdown b. User error(s) or purposeful interruption(s) of the user service (e.g. if the client shuts his/her own server down, FarOffice is not responsible for the downtime) c. Failures due to software that is not explicitly supported by FarOffice. Consequently, if a hardware crash provoked by the customer happens, this is beyond the control and responsibility of FarOffice for the resulting downtime.
5. ACCOUNT/DATA BACKUP
Our backup service is provided as a courtesy to you, and, therefore, faroffice.co.uk will be in no way held responsible for the files stored in your account. You, as a customer, agree to take full responsibility for all the files in your account and to maintain an appropriate backup of the data stored on our servers. We will back up the files located in the /httpdocs folder of your account, as well as the databases you have created. Backups are only kept for a period of 30 days. After this period, a backup cannot be restored. General Backup: The default available backup disk storage space for each customer is 5 GB. User accounts with content over 5 GB cannot be (partially or entirely) backed up. We provide backup services only to accounts with disk space usage below the purchased backup quota limit. For example, if the purchased data backup quota amounts to 20 GB, we will back up your files as long as your account’s disk usage does not exceed the 20 GB quota limit. As soon as this 20 GB quota limit has been reached — the backup script will no longer back up any of your files. Database Backup: Our database backup script WILL NOT back up databases, which contain more than 256 tables. Databases bigger than that take too much time and use too much of the server’s resources to be backed up.
6. SERVER USAGE & HOSTED CONTENT
a. Server content MUST comply with the parameters stated in these TOS. Web content requirements exclude the publication of illegal content or content considered inappropriate otherwise. Customers should get in touch with FarOffice regarding any enquiries over the matter. b. If any of FarOffice Services are used for the illegal purpose of SPAM or UCE, then they will be immediately terminated. c. Unauthorised Access. FarOffice expressly bans the use of any FarOffice hardware or software hosted on a FarOffice server for trying to illegally access another hosted machine or network. d. It is not recommended to use FarOffice temporary URL as a base URL. Users are advised to redirect their traffic to their own domain. “UNLIMITED” USAGE POLICIES AND DEFINITIONS The term “UNLIMITED” is used to describe the amount of resources in the web hosting plans provided by FarOffice, which is not set to a predefined limit value (for example - unlimited bandwidth, unlimited disk space, unlimited emails or other unlimited resources). By not setting limits on key resources, we are able to offer our customers a simple, consistent pricing scheme as their websites demand more and more resources. As a result, a typical website may experience periods of great popularity and a resulting increased storage need without experiencing any associated increase in hosting charges. In all cases, when a service is listed as “Unlimited”, it is intended for normal web hosting usage only — all activities, which may result in excessive resource usage inconsistent with regular usage patterns, are prohibited. Our Unlimited service offers are not designed to allow a single user to influence the overall server performance. FarOffice will make every effort to provide its customers with additional resources whenever possible, including the relocation of a customer’s hosting account to a newer, faster server. If the resource usage reaches a level where it may influence the overall server performance in a negative way, FarOffice will make every effort to come to an agreement with the customer on reducing the resource usage to acceptable levels, however if agreement cannot be reached, then FarOffice reserves the right to take corrective actions. Such actions may include disconnection or discontinuance of any and of all offered services, removal or deletion of customers’ websites, website content, electronic mail, or termination of a customer’s account according to FarOffice’s sole and absolute discretion.
7. SERVICE ACTIVATION AND CONTINUANCE TIMESCALE
SERVICE ACTIVATION New customers: services are activated immediately after cleared payment is received. Existing customers: services, including upgrades and renewals, are activated immediately after we receive cleared payment.
8. SERVICE TERMINATION
Hosting contracts are whole year contracts. You may terminate hosting services with FarOffice Limited by providing one full calendar month’s notice to us. Your hosting will cease at 23:59 GMT on the last day of hosting. It is your responsibility to obtain any code from FarOffice Limited’s servers prior to termination. You may request a copy of your files, prior to termination, and these will be provided in zipped format. There is an administration fee for this service. Upon termination of your service files, data or back-ups will no longer be available.
Hosting costs will be quoted when we know your file storage and bandwidth requirements.
